There is new estate-planning legislation in BC called the Wills, Estates and Succession Act (“WESA”) which came into effect March 31, 2014, and replaced most of our existing estate-planning legislation and also our legislation dealing with probate. There are far too many changes to cover off in a short column, so I will try to address one each month for the next while. Section 155(1) of WESA replaces and broadens section 12 of the Wills Variation Act. It states that distribution of the estate is prohibited within 210 days of the grant of probate without consent of all beneficiaries and intestate successors entitled to the estate.
